1. Agreement to Terms
1.1 By clicking "Continue" during the account registration process, or by otherwise accessing or using the HeyU mobile application ("App"), you expressly agree to be bound by:
- These Terms of Service ("Terms")
- Our Privacy Policy
- Any other policies or guidelines incorporated by reference
1.2 If you disagree with any part of these terms, you may not access or use the App.
1.3 Your agreement to these Terms forms a legally binding contract with Shadow Particle AB ("we," "us," or "our").
2. Eligibility
2.1 You must be at least 16 years old to use the App.
2.2 By using the App, you represent and warrant that you meet the age requirement and have the right, authority, and capacity to agree to these Terms.
2.3 If you are between the ages of 16 and 18 (or the age of legal majority in your jurisdiction), you may only use the App with the involvement and consent of a parent or legal guardian.
2.4 We reserve the right to request verification of age at any time. If we discover that you do not meet our age requirements, we may terminate your account.
3. Account Registration
3.1 You must register for an account to use the App.
3.2 You agree to provide accurate, current, and complete information during registration.
3.3 You are responsible for maintaining the confidentiality of your account credentials.
3.4 You agree to immediately notify us of any unauthorized use of your account.
3.5 We reserve the right to refuse registration, terminate accounts, or remove content at our discretion.
4. In-app Purchases
4.1 Subscriptions Plans
- The App offers premium features through subscription plans
- Subscription details and pricing are displayed in the App
- All subscriptions are billed through Apple's App Store
- Subscription fees are non-refundable except as required by law
- Subscriptions automatically renew unless canceled at least 24 hours before the renewal date
- You can manage and cancel subscriptions through your Apple App Store settings
- We will provide notice of any price changes at least 30 days before they take effect
4.2 Consumable Items
- Saves: Allow you to save profiles for later viewing
- Rewinds: Allow you to go back to previously viewed profiles
- Consumable items are non-refundable once used
- Unused consumables remain available in your account
- Consumables cannot be transferred between accounts
4.3 Payment Terms
- All payments are processed through Apple's App Store
- Prices are subject to change with notice
- You agree to pay all charges at the prices then in effect
- You authorize the use of Apple's payment system for billing
- Prices shown may not include applicable taxes
- You are responsible for any taxes that may apply
4.4 Refund Policy
- Refund requests must be made through Apple's App Store
- We do not directly process refunds for purchases
- Approved refunds will be issued through Apple's system
- Refunded purchases may result in loss of associated features or consumables
- Abuse of refund system may result in account suspension
5. User Conduct
5.1 Your Content
You agree not to:
- Use the App for any illegal purpose or to promote illegal activities
- Harass, abuse, stalk, threaten, or otherwise violate others' rights
- Create false, misleading, or deceptive profiles
- Share explicit, inappropriate, or offensive content
- Attempt to circumvent any App limitations or security measures
- Use automated systems, bots, or scripts to access the App
- Reverse engineer, decompile, or modify the App
- Access the App through unauthorized means
- Collect or harvest user data
- Interfere with other users' enjoyment of the App
- Engage in commercial activities without our prior written consent
- Use the App to transmit malware, viruses, or other harmful code
5.2 Account Security
You must:
- Maintain the security of your account credentials
- Not share your account with others
- Not sell, transfer, or lease your account
- Not access accounts belonging to others
- Report any security breaches immediately
5.3 Communication Guidelines
- Be respectful in all interactions
- Do not send spam or unwanted messages
- Do not solicit or promote commercial services
- Do not share harmful or malicious content
- Report abusive communications
- Do not share contact information with users you don't know
- Consider the privacy and comfort of others
5.4 Meeting Safety
- Exercise caution when meeting other users
- Meet only in public places
- Do not share financial information
- Report suspicious behavior
6. Content Guidelines
6.1 Your Content
- You retain rights to content you create
- You grant us license to use your content for App operations
- You are responsible for your content's legality
- You represent that you have necessary rights to share your content
- We may remove or moderate any content at our discretion
6.2 Prohibited Content
The following content is strictly prohibited:
- Explicit sexual content or nudity
- Harassment, bullying, or hate speech
- Violence or graphic content
- False or misleading information
- Spam or commercial solicitation
- Content violating others' rights
- Personal contact information
- Financial information or payment details
- Content promoting illegal activities
- Impersonation of others
- Content that exploits or harms minors
- Content that promotes self-harm, suicide, or eating disorders
- Discriminatory content based on race, gender, religion, nationality, disability, sexual orientation, or age
6.3 Content Moderation
- We may review, screen, or monitor content
- We may remove content without notice
- We may suspend accounts posting prohibited content
- Users can report inappropriate content
- We cooperate with law enforcement when required
- We aim to review reports within 48 hours
6.4 Intellectual Property Rights
- You maintain ownership of your content
- You grant us worldwide, non-exclusive license to use your content
- You respect others' intellectual property rights
- We handle copyright claims according to applicable laws
- We may remove content subject to copyright claims
7. Privacy and Data Protection
7.1 Privacy Policy
Your use of the App is subject to our Privacy Policy , incorporated by reference.
7.2 Data Collection and Usage
- We collect and use information as described in the Privacy Policy
- We process personal data in accordance with applicable data protection laws, including the GDPR where applicable
- We implement appropriate technical and organizational measures to protect your data
7.3 Your Data Rights
You have the right to:

- Correct inaccurate personal data
- Delete your personal data in certain circumstances
- Restrict or object to processing in certain circumstances
- Data portability (receive your data in a structured, commonly used format)
- Withdraw consent at any time (where processing is based on consent)

7.4 Data Retention
- We retain your personal data for as long as necessary to provide our services
- We will delete your data upon account deletion

8. Intellectual Property

9. Account Suspension and Termination
9.1 Account Actions
- Shadow Particle AB reserves the right to suspend or terminate your account for any violations of these Terms
- Account suspension may be temporary or permanent, at our discretion
- We may issue warnings before suspension when appropriate
- Suspension decisions are final and at our sole discretion
9.2 Effects of Suspension
- During suspension, you may not be able to access the App or its features
- Subscriptions will continue to bill during temporary suspensions
- Unused consumables (Saves and Rewinds) will be frozen during suspension
- You will not receive refunds for subscription time or consumables during suspension
9.3 Effects of Termination
- Permanent account termination will cancel active subscriptions
- Unused consumables will be forfeited upon termination
- You will not receive refunds for terminated accounts
- All user content may be removed or retained at our discretion
9.4 User-Initiated Termination
- You may terminate your account at any time through the App settings
- Active subscriptions must be cancelled through Apple's App Store
- Unused consumables will be forfeited upon account deletion
- Your personal data will be handled as described in our Privacy Policy
10. Account Deletion and Data Retention
10.1 Account Deletion Process
- You can delete your account through the "Delete Account" option in App settings
- Alternatively, you can request account deletion by contacting support@shadowparticle.com
- We will verify your identity before processing deletion requests
- Account deletion is permanent and cannot be reversed
10.2 Effects of Account Deletion
- All personal profile information will be deleted
- Your content will be removed from public view immediately
- Active subscriptions must be canceled separately through Apple App Store
- Unused consumables will be forfeited
11. Service Availability and Modifications
11.1 App Availability
- We strive to maintain App availability but do not guarantee uninterrupted service
- We may modify or discontinue features with notice
- Scheduled maintenance will be communicated when possible
- We are not liable for any App downtime or technical issues
11.2 App Updates
- We may release updates to fix bugs, improve features, or comply with regulations
- You are responsible for installing updates when available
- Some updates may be mandatory for continued use of the App
- Older versions of the App may cease to function after certain updates
11.3 Technical Requirements
- You are responsible for maintaining compatible devices and software
- We do not guarantee compatibility with all devices or operating systems
- Minimum system requirements will be specified in the App Store listing
11.4 Service Support and Response Times
- Customer support is available at support@shadowparticle.com
- We aim to respond to support inquiries within 2 business days
- Critical issues will be prioritized based on severity
- Support hours are Monday-Friday, 9:00-17:00 CET, excluding Swedish holidays
12. Disclaimers
12.1 App Provided "As Is"
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE MAKE NO WARRANTIES ABOUT ACCURACY, RELIABILITY, OR AVAILABILITY. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE. WE DO NOT WARRANT THAT DEFECTS WILL BE CORRECTED.
12.2 User Content and Interactions
WE DO NOT GUARANTEE THE ACCURACY OF USER PROFILES OR CONTENT. WE ARE NOT RESPONSIBLE FOR USER INTERACTIONS OR THEIR OUTCOMES. WE DO NOT VERIFY USER IDENTITIES OR BACKGROUNDS. WE DO NOT GUARANTEE MATCHES OR RELATIONSHIPS. ALL USER INTERACTIONS ARE AT YOUR OWN RISK AND RESPONSIBILITY.
12.3 Third-Party Services
WE ARE NOT RESPONSIBLE FOR THIRD-PARTY SERVICES. APP STORE SERVICES ARE GOVERNED BY APPLE'S TERMS. EXTERNAL LINKS ARE PROVIDED FOR CONVENIENCE ONLY. WE DO NOT ENDORSE LINKED THIRD-PARTY CONTENT.
12.4 Technical Requirements
YOU ARE RESPONSIBLE FOR YOUR DEVICE COMPATIBILITY. WE DO NOT GUARANTEE APP COMPATIBILITY WITH ALL DEVICES. YOU MUST MAINTAIN NECESSARY SOFTWARE UPDATES. YOU ARE RESPONSIBLE FOR YOUR NETWORK CONNECTION.
13. Limitation of Liability
13.1 Liability Limits
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
- LOST PROFITS OR BUSINESS INTERRUPTION
- DATA LOSS OR CORRUPTION
- DAMAGE TO YOUR DEVICE OR SYSTEMS
- PERSONAL INJURY OR EMOTIONAL DISTRESS
- COSTS OF SUBSTITUTE SERVICES
13.2 Liability Cap
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS
- FOR FREE SERVICES, LIABILITY IS LIMITED TO 100 SEK
- THESE LIMITATIONS APPLY TO ALL CAUSES OF ACTION
13.3 Exceptions
- THESE LIMITATIONS DO NOT EXCLUDE LIABILITY FOR GROSS NEGLIGENCE
- MANDATORY CONSUMER PROTECTION LAWS STILL APPLY
- FRAUD OR INTENTIONAL MISCONDUCT ARE NOT LIMITED
13.4 Time Limitation
- YOU MUST BRING ANY CLAIM WITHIN ONE YEAR
- THIS TIME LIMIT APPLIES TO ALL CLAIMS
- FAILURE TO ACT WAIVES YOUR RIGHTS
14. Governing Law and Dispute Resolution
14.1 Governing Law
- These Terms are governed by the laws of Sweden
- Your contracting entity is Shadow Particle AB
- Swedish law applies to the extent permitted by your local laws
- EU consumers retain their mandatory consumer protection rights
14.2 Dispute Resolution
- Any disputes shall be resolved through binding arbitration in accordance with the Swedish Arbitration Act (Lag om skiljeförfarande)
- The arbitration shall take place in Stockholm, Sweden
- The arbitration shall be conducted in English
- Each party bears their own costs unless otherwise decided by the arbitrator
- Small claims may be brought in local courts where permitted by law
14.3 EU Consumer Rights
- EU consumers may use the EU Online Dispute Resolution platform at http://ec.europa.eu/consumers/odr
- Nothing in these Terms affects your statutory rights as a consumer under Swedish and EU law
- You may choose your local courts if mandatory consumer laws require it
- Local consumer protection laws apply where mandatory
12.4 Class Action Waiver
- You agree to resolve disputes individually
- No class actions or representative proceedings
- This waiver applies to the extent permitted by law
12.5 Time Limitation
- Claims must be filed within one year of the incident
- Claims filed after one year are permanently barred
- This limitation applies where legally permitted
15. Changes to Terms
15.1 We may modify these Terms at any time.
15.2 Continued use of the App after changes constitutes acceptance.
15.3 We will notify users of material changes via the App.
15.4 If you do not agree with the changes, you must stop using the App and cancel your subscription.
16. Accessibility
16.1 We are committed to making our App accessible to all users, including those with disabilities.
16.2 We strive to conform to WCAG 2.1 AA standards where possible.

17. Data Portability Rights
17.1. Data Export Feature
- You can export your personal data directly through the App's "Export My Data" feature
- Data will be provided in JSON format
- The export process is secure and protected by your account authentication
- Export requests are processed immediately through the App

- Your profile information and preferences
- Your interaction history (anonymized)
- Your subscription and purchase history
17.3. Data Privacy Protection
- Other users' personal information will be anonymized
- Certain data may be excluded to protect other users' privacy
- Interaction records will be provided in a way that prevents identification of other users
17.4. Alternative Request Process
- If you cannot use the in-app export feature, you may request your data via email at support@shadowparticle.com
- We will process email requests within 30 days
- Verify your identity when requested
- We'll provide instructions for downloading your data securely
18. Safety and Interactions
18.1 User Safety
- We do not conduct background checks on users
- We do not verify user identities unless explicitly stated
- Users are responsible for their own safety when meeting others
- Report suspicious behavior through the App's reporting features
18.2. Meeting Guidelines
- Exercise caution when meeting users in person
- Meet in public places for initial meetings
- Do not share personal financial information
- Be aware that Shadow Particle AB is not responsible for user interactions outside the App
19. Apple App Store Terms
19.1 These Terms are between you and us, not Apple.
19.2 Apple has no obligation to provide maintenance or support.
19.3 Apple is not responsible for addressing claims relating to the App.
19.4 Apple is a third-party beneficiary of these Terms.
